Saudi Arabia’s New Enforcement Law: A Step Towards a More Efficient Legal System

Saudi Arabia has introduced a new Enforcement Law as part of its ongoing efforts to improve its legal and judicial system. The purpose of the law is to make enforcement procedures more organized, transparent, and efficient, while helping people recover their rights faster. This also supports the goals of Saudi Vision 2030.

The law gives the Enforcement Judge broad authority to make sure enforcement procedures are carried out properly. The Enforcement Judge can supervise enforcement procedures, resolve disputes, order people to disclose their assets, impose travel bans, and oversee insolvency matters when a person is unable to pay their debts.

The law also states that enforcement can only happen if there is an enforceable instrument, such as a court judgment, arbitration award, commercial paper, notarized agreement, or a foreign judgment that meets the legal requirements.

One important feature of the law is its focus on financial transparency. The Enforcement Judge can order a debtor to disclose what they own and may seize those assets to recover unpaid debts. In some situations, the court may even order disclosure before notifying the debtor if there are concerns that assets may be hidden or transferred.

Government authorities, banks, accountants, employees, and other related parties may also be required to provide information about the debtor’s assets within a certain period of time.

The law also explains which assets can and cannot be seized. For example, a person’s home, necessary personal belongings, work tools, and part of their salary or income may be protected in some situations.

One of the main differences between the old system and the new Enforcement Law is that the new law focuses more on financial enforcement and asset disclosure rather than relying mainly on broad restrictive measures against the debtor. The new system places more emphasis on tracing and seizing assets instead of focusing on punishing the person who owes money.

Overall, the new Enforcement Law shows Saudi Arabia’s efforts to create a more modern, fair, and efficient legal system. The law is part of the Kingdom’s wider plan to improve the judicial system and strengthen confidence in legal procedures.
